1. Agreement to Terms

By downloading, installing, or using the Colorito mobile application ("App"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

For children's use: By allowing a child to use Colorito, you confirm that you are the child's parent or legal guardian and accept these Terms on behalf of yourself and the child.

2. Description of Service

Colorito is a mobile application that allows users to:

• Create custom coloring pages using AI-generated artwork
• Color and decorate generated images using digital tools
• Save and manage artwork in a personal gallery
• Access premium features through optional subscription

3. User Eligibility

• Colorito is designed for children ages 3-8
• Children should use the App under parental supervision
• Only parents or legal guardians may make purchases
• You must be at least 18 years old to create an account or make purchases

4. Subscriptions and Payments

4.1 Free Features

Colorito offers free features including:

• Limited AI-generated coloring pages per day
• Basic coloring tools and colors
• Ability to save artwork locally

4.2 Premium Subscription ("Colorito Pro")

Premium features include:

• Unlimited AI-generated coloring pages
• Extended color palette (24 colors)
• Special effects (glitter, rainbow, patterns)
• Ad-free experience

4.3 Pricing

• Monthly: $4.99 USD per month
• Yearly: $29.99 USD per year (best value)
• Lifetime: $49.99 USD one-time purchase

Prices may vary by region and are subject to change.

4.4 Billing and Renewal

• Payment is charged to your Apple ID or Google Play account
• Subscriptions renew automatically unless cancelled
• You can manage or cancel subscriptions in your device settings
• No refunds for partial subscription periods

4.5 Cancellation

To cancel your subscription:

• iOS: Settings → Your Name → Subscriptions → Colorito → Cancel
• Android: Play Store → Menu → Subscriptions → Colorito → Cancel

After cancellation, you will retain access until the end of your current billing period.

5. User Content and Artwork

5.1 Your Artwork

Artwork you create in Colorito belongs to you. You may:

• Save artwork to your device
• Share artwork with family and friends
• Print artwork for personal use

5.2 AI-Generated Base Images

The coloring page outlines generated by AI are provided for your personal use within the App. You may not:

• Sell AI-generated images commercially
• Claim AI-generated images as entirely your own original work
• Use generated images to train other AI systems

6. Acceptable Use

You agree NOT to:

• Attempt to bypass the parent gate or any security features
• Use the App for any illegal purpose
• Reverse engineer, decompile, or disassemble the App
• Attempt to manipulate AI generation for inappropriate content
• Share or distribute the App through unauthorized channels
• Use automated systems to access the App

7. Safety and Content Moderation

We implement safety measures including:

• Curated selection of characters, scenes, and actions
• AI content filtering to prevent inappropriate outputs
• No user-to-user communication features
• No external links accessible to children

While we strive to ensure all content is child-appropriate, AI-generated content may occasionally produce unexpected results. We encourage parental oversight.

8. Intellectual Property

8.1 Our Property

Colorito, including its code, design, features, "Colo" mascot character, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute our App or its components.

8.2 Third-Party Content

Some icons, fonts, and assets may be licensed from third parties and remain their property.

9. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect information. Key points:

• We do NOT collect personal information from children
• Artwork is stored locally on your device only
• We comply with COPPA requirements

10. Disclaimers

10.1 "As Is" Service

Colorito is provided "as is" without warranties of any kind. We do not guarantee that:

• The App will be error-free or uninterrupted
• AI-generated content will meet specific expectations
• All features will be available at all times

10.2 AI Limitations

AI-generated coloring pages are created algorithmically and may vary in quality or interpretation. We continuously work to improve outputs but cannot guarantee specific results.

11. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid us in the past 12 months
• We are not responsible for any loss of data stored locally on your device

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your violation of these Terms or misuse of the App.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Updating the "Last Updated" date
• Providing notice within the App
• Posting updates on our website

Continued use of the App after changes constitutes acceptance of the new Terms.

14. Termination

We may suspend or terminate your access to Colorito if you violate these Terms. You may stop using the App at any time by uninstalling it. Upon termination:

• Your right to use the App ends immediately
• We may delete any data associated with your use
• Subscription fees already paid are non-refundable

15. Governing Law

These Terms are governed by the laws of Mexico, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Mexico City, Mexico.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Colorito regarding use of the App.
